Terms of Use

1. Acceptance of terms

By accessing or using Onwards Upwards, you agree to be bound by these Terms of Use. If you do not agree, do not use the service.

2. Your account

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Your content

Journal entries and other content you create remain yours. You grant us a limited license to store and process this content solely to operate the service.

4. Acceptable use

Do not misuse the service, including by attempting to disrupt it, reverse engineer it, or use it to violate any law or third-party right.

5. Not a medical service · No medical advice

Onwards Upwards is a self-reflection journaling tool. It is not a medical device, not a diagnostic tool, not therapy, and not a substitute for professional mental health care. Nothing in the service constitutes medical, psychological, or psychiatric advice. We are not a HIPAA Covered Entity or Business Associate. If you are experiencing a mental-health crisis or thoughts of harming yourself or others, stop using the service and contact a qualified professional or your local emergency services immediately.

5a. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use Onwards Upwards. The service is not directed at children under 13 and we do not knowingly collect their data.

In compliance with the US Children's Online Privacy Protection Act (COPPA), if you are a parent or guardian and believe a child under 13 has provided us with personal information, contact us at privacy@onwardsupwards.app and we will delete the account and associated data promptly. We do not condition any child's participation in any activity on disclosing more information than is reasonably necessary.

5b. Disclaimer of warranties & liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our aggregate liability for any claim arising out of the service is limited to the greater of the fees you paid us in the 12 months preceding the claim or USD 50. Nothing in these terms excludes liability that cannot be excluded by law (e.g. gross negligence, fraud, or statutory consumer rights).

5c. Governing law

These terms are governed by the laws of England & Wales, without prejudice to any mandatory consumer-protection rights you have in your country of residence. Disputes shall be resolved in the courts of England & Wales, unless your local law gives you the right to sue in your own jurisdiction.

6. Termination

You may stop using the service at any time. We may suspend or terminate access if you breach these terms or to protect the service and its users.

6a. Paid subscriptions (when offered)

Onwards Upwards is currently free. If and when we introduce paid subscriptions, the following will apply in addition to these terms:

  • EU/EEA — 14-day withdrawal. Under the EU Consumer Rights Directive 2011/83/EU and Digital Content Directive (EU) 2019/770, EU/EEA consumers have a 14-day right of withdrawal. Where you expressly request immediate access to digital content and acknowledge loss of the withdrawal right, that right may lapse for content already supplied.
  • UK — DMCC Act 2024. UK consumers will receive the pre-contract, reminder, and easy-exit notices required by the Digital Markets, Competition and Consumers Act 2024 for subscription contracts, including clear renewal reminders and a cancellation mechanism at least as easy as the sign-up flow.
  • US — FTC "Click-to-Cancel". US subscribers will be able to cancel through the same medium they used to sign up, in as few steps, without retention friction, consistent with the FTC's Negative Option / "Click-to-Cancel" rule.
  • Payment data. Card data is handled by a PCI DSS Level 1 payment processor (e.g. Stripe / Paddle) via hosted fields; Onwards Upwards does not store, process, or transmit primary account numbers and is therefore out of scope for PCI DSS as a merchant of record beyond SAQ A.

7. Changes

We may update these terms from time to time. Continued use after changes constitutes acceptance of the revised terms.
